SSAWAY Terms and Conditions
These Terms and Conditions apply to your use of the SSAWAY website and services. By accessing our website, creating an account or using our services, you agree to be bound by these Terms and Conditions.
1. About SSAWAY
SSAWAY is an Australian-based digital currency exchange service. SSAWAY provides fiat-to-crypto and crypto-to-fiat exchange services.
SSAWAY currently supports USDT and USDC transactions. BTC-related exchange services are planned to be introduced in the future.
2. Service scope
SSAWAY provides digital currency exchange services only. This means we may help customers:
- exchange AUD into supported digital currency;
- exchange supported digital currency into AUD;
- receive digital currency to a wallet address provided by the customer;
- process Australian payment methods, including PayID and bank transfer.
SSAWAY does not provide financial advice, investment advice, tax advice, legal advice or portfolio management services.
3. No investment advice
Any information on the SSAWAY website is general information only. It does not take into account your personal objectives, financial situation or needs.
You are responsible for deciding whether digital currency transactions are suitable for you. Digital currency prices may be volatile and you may lose money.
4. Eligibility
To use SSAWAY, you must:
- be at least 18 years old;
- provide accurate and complete information;
- use the service only for lawful purposes;
- comply with identity verification and AML/CTF requirements;
- not use SSAWAY for scams, fraud, money laundering, terrorism financing or illegal activity.
SSAWAY may refuse, suspend or terminate service where required for compliance, risk management or security reasons.
5. Account registration
You may need to create an account before using SSAWAY's services. You are responsible for keeping your account details, password and devices secure.
You must notify SSAWAY immediately if you suspect unauthorised access to your account.
6. Identity verification
Before providing services, SSAWAY may require you to complete identity verification. This may include providing personal information, identity documents, source of funds information or other supporting documents.
SSAWAY may use third-party verification and screening providers to complete KYC and AML/CTF checks.
SSAWAY may delay, reject, cancel or limit transactions if verification is incomplete, suspicious, inconsistent or required by law.
7. Customer responsibilities
You are responsible for:
- providing accurate personal information;
- ensuring payment details are correct;
- ensuring wallet addresses are accurate;
- confirming you control or have permission to use the wallet address provided;
- checking transaction details before submitting an order;
- understanding the risks of digital currency transactions;
- complying with applicable laws.
8. Wallet addresses and irreversible transactions
SSAWAY does not provide custodial wallet services. When you buy digital currency, it will be sent to the wallet address you provide.
You must carefully check the wallet address before submitting an order. Digital currency transactions are generally irreversible once sent on the blockchain.
SSAWAY is not responsible for losses caused by incorrect wallet addresses, unsupported networks, customer error, third-party wallet issues or blockchain network issues.
9. New wallet address test transfer
For customer protection, SSAWAY may process the first order using a new wallet address in two parts.
SSAWAY may first send a small test transfer, such as $10 AUD worth of crypto, to the wallet address provided. Once you confirm the test transfer has been received, SSAWAY may process the remaining balance.
For example, a $500 AUD order may be processed as $10 AUD first, followed by $490 AUD after confirmation.
This process is designed to reduce the risk of loss from an incorrect wallet address, but it does not remove your responsibility to provide accurate wallet details.
10. Payments
SSAWAY may accept Australian payment methods including PayID and bank transfer.
You must only make payments from an account that belongs to you, unless SSAWAY has approved otherwise. SSAWAY may reject or delay payments that appear suspicious, incomplete, mismatched or inconsistent with customer information.
11. Pricing, quotes and fees
Exchange rates, quotes and fees may change based on market conditions, liquidity, payment method, transaction size and operational factors.
A quote may only be valid for a limited time. SSAWAY may update, withdraw or reject a quote before the transaction is confirmed.
Any applicable fees will be disclosed before or during the transaction process where practical.
12. Processing times
Processing times may vary depending on payment processing, compliance checks, wallet providers, blockchain networks, liquidity and operational factors.
SSAWAY does not guarantee that any transaction will be completed within a specific timeframe unless expressly confirmed in writing.
13. Blockchain network risks
Blockchain transactions may be affected by network congestion, confirmation delays, incorrect networks, wallet provider issues, technical failures or other factors outside SSAWAY's control.
SSAWAY is not responsible for delays or losses caused by blockchain networks, third-party exchanges, wallet providers or customer-selected wallet addresses.
14. Transaction limits
SSAWAY may apply minimum and maximum transaction limits. Limits may vary depending on customer risk profile, verification status, payment method, transaction history, liquidity and compliance requirements.
SSAWAY may change transaction limits at any time.
15. Suspicious activity and compliance holds
SSAWAY may delay, block, cancel, review or report transactions where required for AML/CTF compliance, fraud prevention, sanctions screening, risk management, regulatory obligations or law enforcement requests.
SSAWAY may request additional information from you before processing or completing a transaction.
16. Refunds and cancellations
Refunds and cancellations are handled at SSAWAY's discretion and may depend on the transaction status.
Once digital currency has been sent to a wallet address, the transaction generally cannot be reversed. SSAWAY may not be able to refund transactions affected by incorrect wallet addresses, customer error, unsupported networks or blockchain processing issues.
17. Prohibited use
You must not use SSAWAY to:
- commit fraud;
- launder money;
- finance terrorism;
- evade sanctions;
- receive or send proceeds of crime;
- impersonate another person;
- use stolen payment details;
- provide false or misleading information;
- conduct transactions for another person without disclosure;
- breach any applicable law.
SSAWAY may suspend or terminate access if prohibited activity is suspected.
18. Third-party services
SSAWAY may use third-party providers for identity verification, payment processing, AML/CTF screening, fraud prevention, hosting, analytics and security.
SSAWAY is not responsible for the actions, delays, failures or terms of third-party providers, except where required by law.
19. Website availability
SSAWAY aims to provide reliable website access but does not guarantee uninterrupted availability. The website may be unavailable due to maintenance, technical issues, cybersecurity incidents, third-party service failure or other operational reasons.
20. Limitation of liability
To the maximum extent permitted by law, SSAWAY is not liable for losses caused by:
- incorrect wallet addresses;
- customer error;
- unauthorised account access caused by customer negligence;
- blockchain network delays or failures;
- third-party wallet or exchange issues;
- market price movements;
- payment delays;
- force majeure events;
- regulatory or compliance holds.
Nothing in these Terms excludes rights that cannot be excluded under Australian law.
21. Privacy
Your personal information will be handled in accordance with SSAWAY's Privacy Policy.
By using SSAWAY's services, you consent to SSAWAY collecting, using and verifying your information for service delivery, identity verification, AML/CTF compliance, fraud prevention, transaction processing and regulatory purposes.
22. Changes to these Terms
SSAWAY may update these Terms and Conditions from time to time. Updated terms will be published on the website. Continued use of the website or services after changes are published means you accept the updated terms.
23. Governing law
These Terms and Conditions are governed by the laws of Australia and, where applicable, the laws of the state or territory in which SSAWAY operates.
